Terms of Service

1. The Service

wintop is an accountless public product leaderboard. Eligible paid bids collected during one weekly bidding period determine the leaderboard displayed during the following weekly period. Boards switch Wednesday at 00:00 UTC. Completed weeks may remain in a public archive.

“Service” includes the website, APIs used by the website, leaderboard, checkout initiation, product metadata preview, click redirects, traffic statistics, archives, and support. “wintop,” “we,” “us,” and “our” refer to the operator of the Service. “You” means each visitor, submitter, purchaser, or person acting for an organization.

The detailed operational rules at How wintop works are incorporated into these Terms. If those rules conflict with these Terms, these Terms control for legal issues and the Payment Terms control for purchases.

2. Eligibility and authority

You may browse the general-audience Service only if permitted by applicable law. To submit a product or place a paid bid, you must be at least 18 and have reached the age of legal majority where you live. If you act for a company or another person, you represent that you have authority to bind them, and “you” includes that party.

You may support a product without proving ownership, but you must have the right to submit all text, links and images you provide. You may not falsely claim affiliation, sponsorship, ownership, endorsement, or authorization.

3. Product submissions and license

A submission may include a URL or X handle, product name, description, icon, display name and related metadata (“User Content”). Some metadata may be suggested from a public webpage, but you must review it before checkout and remain responsible for its accuracy, legality and permissions.

You retain any rights you hold in User Content. You grant wintop a worldwide, non-exclusive, royalty-free, sublicensable license to host, cache, copy, reproduce, adapt for formatting or accessibility, publicly display, distribute and link to User Content as reasonably necessary to operate, promote, secure and archive the Service. This license continues for public archives and operational backups unless content is removed, except where continued retention is permitted by law or reasonably necessary for transaction, dispute, fraud or historical records.

You represent that User Content and our permitted use of it do not violate law, privacy, publicity, confidentiality, contract, trademark, copyright or other rights. Do not submit confidential information.

4. Acceptable use

You must not use the Service to:

• promote illegal, fraudulent, deceptive, infringing, defamatory, hateful, violent, exploitative, adult, or unsafe content, goods, or services;
• submit malware, phishing, credential theft, unauthorized financial schemes, impersonation, manipulated metadata, embedded credentials, private-network addresses, or prohibited destinations;
• violate sanctions, export controls, anti-money-laundering rules, consumer-protection law, advertising law, payment-network rules, or another person's rights;
• artificially inflate traffic or clicks, manipulate rankings outside the published bid process, automate abusive requests, evade technical limits, interfere with the Service, probe vulnerabilities without written authorization, or access non-public systems or data;
• copy, scrape or use the Service in a manner that creates unreasonable load, bypasses controls, or violates law; or
• help another person do any of the above.

Technical filters are not a complete statement of prohibited conduct. Passing an automated check does not make a submission acceptable.

5. Ranking, public results and moderation

Rankings are calculated under the published rules using completed, unrefunded contributions for a specific cycle, with deterministic tie-breakers. Previewed or predicted positions are estimates, not reservations or guarantees. Other completed payments and refunds may change current or archived positions.

We may investigate, reject, remove, correct, de-index, disable, or restrict any submission, destination, bid, click activity, or access that we reasonably believe violates these Terms, creates legal or security risk, misleads users, harms the Service, or is required to be removed. Where practical, you may contact support to contest a decision. We are not required to preserve a particular listing or rank when moderation, refund, payment reversal, law, or technical correction requires a change.

6. Payments, third-party services and links

Paid bids are governed by the Payment Terms. Checkout is provided by Waffo as merchant of record and may also be subject to Waffo's customer-facing terms and privacy policy. Waffo, payment networks, banks, and fraud providers may independently accept, reject, review, tax, refund, or dispute transactions.

Product destinations and other external services are not controlled by wintop. A listing is not an endorsement, warranty, partnership, or verification of the destination, product, submitter, or claim. You visit, purchase from, or interact with third parties at your own risk and under their terms.

7. wintop intellectual property

The Service, including its original software, interface, design, branding, compilation, and documentation, is owned by wintop or its licensors and is protected by applicable intellectual-property law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for its intended purpose.

Except as permitted by law, you may not reproduce, distribute, sell, license, reverse engineer, remove notices from, or create derivative works of protected portions of the Service without written permission. Product names, marks and content displayed in listings remain the property of their respective owners.

Send copyright, trademark, or other rights complaints to bonatokenl@gmail.com with identification of the work or right, the disputed material and URL, your contact details, a good-faith explanation, and evidence of authority. We may forward a complaint to the submitter where appropriate.

8. Availability, suspension and changes

We may maintain, modify, suspend, or discontinue all or part of the Service; impose reasonable technical limits; or change future features and rules. We will not retroactively change the economic treatment of a completed transaction except where required for a refund, reversal, dispute, fraud correction, legal obligation, or to fix an error consistently with the applicable purchase terms.

You may stop using the Service at any time. We may terminate or restrict your access immediately for a material breach, fraud, security risk, legal requirement, or conduct likely to harm others or the Service. Provisions that by their nature should survive will survive, including licenses for existing public archives, payment obligations, disclaimers, liability limits, indemnity, and dispute terms.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.

We do not guarantee any rank, display duration where disrupted by events outside reasonable control, traffic, click volume, conversion, revenue, search indexing, product quality, or business outcome. Nothing on wintop is investment, financial, legal, tax, or professional advice. No provision excludes a warranty or consumer right that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by law, wintop and its personnel, contractors and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, goodwill, data, opportunities, or anticipated savings; or losses arising from third-party content, destinations, payment systems, unauthorized activity, or events beyond reasonable control.

To the maximum extent permitted by law, our aggregate liability arising from the Service or these Terms will not exceed the greater of (a) the amount you paid for the transaction giving rise to the claim or, for a non-transaction claim, the amount you paid to wintop during the twelve months before the event, and (b) US$100. These limits do not apply to liability that cannot legally be limited, including where applicable fraud, willful misconduct, or personal injury caused by negligence.

11. Indemnity

To the extent permitted by law, you will defend, indemnify and hold harmless wintop and its personnel, contractors and affiliates from third-party claims, damages, judgments, losses, liabilities and reasonable costs arising from your User Content, your product or destination, your breach of these Terms, your violation of law or another person's rights, or your fraud or willful misconduct. We will provide reasonable notice and cooperation, and you may not settle a claim in a way that admits fault by or imposes obligations on an indemnified party without consent.

12. Disputes and general terms

Before filing a claim, you and wintop agree to make a good-faith effort for at least thirty days to resolve it informally by emailing bonatokenl@gmail.com with a description of the issue, relevant transaction or listing identifiers, requested resolution, and contact information. This requirement does not prevent urgent injunctive relief or use of a statutory consumer process.

These Terms are governed by the laws mandatorily applicable to the Service operator and the transaction, without depriving a consumer of non-waivable protections of their habitual residence. Any unresolved dispute must be brought before a court with lawful jurisdiction. Nothing here limits a right to contact a regulator, pursue a chargeback where legally valid, or use a mandatory consumer dispute process.

If any provision is unenforceable, it will be enforced to the greatest lawful extent and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a reorganization or transfer of the Service. These Terms, the Privacy Policy, Payment Terms, and incorporated rules are the entire agreement about the Service and supersede prior statements on the same subject.

We may update these Terms for legal, security, technical, or business reasons. Revised Terms apply prospectively from the posted effective date. If a material change requires consent, we will request it. Continued use after other changes take effect constitutes acceptance where permitted by law.
